Real Estate Litigation and Counseling

Jenner & Block Real Estate Litigation and Counseling lawyers combine extensive trial-focused litigation experience and knowledge of the real estate industry to help clients resolve complex problems and analyze and develop cost-effective solutions.  For decades, our lawyers have represented leaders in the real estate industry in some of the most complicated and significant real estate-related litigation across the country.

We represent REITs, developers, brokers, investors, contractors, major landlords and other industry participants in disputes related to nearly every aspect of the real estate industry:  from failed or disrupted deals, to matters testing the limits of the state’s authority in eminent domain actions.  We regularly handle disputes stemming from sophisticated real estate transactions, frequently involving complicated deal structures, financing issues, joint ventures and regulatory issues.

Our lawyers also provide ongoing advice to clients on numerous non-litigation and litigation-avoidance aspects of real estate transactions and business strategy, including negotiating and structuring joint ventures, significant contracts and leases and bidding matters.  We have experience in regulatory and administrative reviews on behalf of real estate and construction industry clients in proceedings before the SEC, OSHA, EPA, the Nuclear Regulatory Commission and in governmental investigations and criminal proceedings.

Our practice regularly uses the experience of the firm’s other practices to address overlapping and related issues, including, for example, in the areas of securities, government contracts, environmental, insurance coverage, labor and employment, bankruptcy and tax law.
