Representative Engagements

  • Successfully defended aerospace manufacturer in DOT and DOD grand jury investigation of alleged fraud; conducted investigation and advised on risk, resolution of commercial claims, corporate disclosures and corrective actions; obtained reasonable civil settlement with no admission of liability.
  • Represented aerospace manufacturer in connection with regulatory, safety, certification and exposure issues arising from product defect; led investigation, advised about testing and product replacement; worked with FAA and EASA to develop airworthiness directives and corrective actions; successfully resolved related commercial disputes with customers.
  • Successfully defended FAA and OSHA investigations of whistleblower claims against aerospace manufacturer, achieving closure of investigations with no adverse action taken.
  • Conducted international commercial arbitration arising under contract for completions of multiple airliners; advised with respect to certification, conformity, and installation issues.
  • Represented manufacturer of full motion flight simulators in connection with deviations from certification standards; led internal investigation and facilitated disclosures to civil aviation authorities of all major jurisdictions, resolving matter without any enforcement action taken against the client.
  • Conducted internal investigation and represented major avionics manufacturer in connection with alleged violations of the Foreign Corrupt Practices Act.
  • Led due diligence activities and advised on international aviation regulatory matters in connection with the acquisition of a Tier 1 multinational aerospace parts manufacturer.
  • Advised aerospace manufacturer on product certification, process improvements, and the development and dissemination of instructions for continued airworthiness.
  • Persuaded the US government not to pursue litigation in a qui tam whistleblower action alleging False Claims Act violations by a major airline.
