Disciplinary Proceedings/Sanctions Litigation

For decades, we have represented individual lawyers and law firms in state disciplinary proceedings and sanctions litigation challenging lawyers’ conduct.  Our experience is critical because it has become common for disciplinary complaints and allegations of unethical conduct to accompany a legal malpractice lawsuit.  Three members of the Professional Responsibility Practice serve as Firm Counsel at Jenner & Block and handle these same types of ethical issues for our own lawyers.  We have also drafted a comprehensive outline analyzing Rule 11, which we rely on internally and share with our clients.

Our experience in this area includes representation of:

  • A senior partner in a large national law firm in civil contempt proceedings arising out of alleged violation of a court order.
  • Clients in an appeal to the Illinois Supreme Court of the trial court’s sanctions award of nearly $1 million stemming from the litigation of a multimillion-dollar trust.
  • An in-house attorney for a governmental agency in a state court sanctions proceeding in Illinois.
  • An in-house patent attorney before the Illinois Attorney Registration and Disciplinary Commission and the US Court of Appeals for the Federal Circuit for alleged “inequitable conduct” before the US Patent and Trademark Office.
  • Lawyers in disciplinary proceedings accusing the lawyers of making improper monetary payments to a sitting judge.
