Fraud and Abuse

Our Attorneys have extensive experience in assisting clients with respect to health care fraud and abuse issues.  We have specific experience in representing hospitals, pharmaceutical companies, and other health care providers in compliance counseling and in defending against civil claims and government investigations.  For example:

  • We defended a major teaching hospital in connection with a government investigation and a qui tam lawsuit arising out of the government’s PATH (Physicians At Teaching Hospitals) initiative.  We have also counseled other hospitals and physician groups on related issues.
  • We have defended several pharmaceutical companies in connection with grand jury investigations involving allegations of anti-kickback violations, improper use of free samples, improper discounts on Medicare-reimbursed injectable drugs, and off-label marketing.
  • We have defended providers who have been indicted for Medicare fraud.
  • We have performed internal investigations for hospitals, pharmaceutical companies, and managed care entities both in response to specific concerns and as part of general compliance counseling.
  • We have developed fraud and abuse compliance programs for large managed care organizations, hospitals, and individual providers and provider groups.
  • We regularly counsel health care providers on how to structure transactions so as to comply with federal and state self-referral statutes
