Representative Engagements - Litigation

  • Representation of the owner in a broad-based litigation dispute with a general contractor relating to construction of a $350 million steel mill in the Chicago area.
  • Litigation arising out of the abandonment of a major nuclear power plant under construction in the Midwest. 
  • Delay and cost-overrun claims relating to three other nuclear power plants in the Midwest. 
  • Litigation relating to alleged engineering defects in the John Hancock building in Chicago. 

  • Litigation regarding alleged architectural and design defects in the U.S. Gypsum building in Chicago. 

  • Representation of a supplier of HVAC components in dispute with the owner, general contractor, and architect/engineer relating to alleged inadequate heating and cooling systems at the State of Illinois Center in Chicago.
  • Insurance coverage litigation on behalf of the architect and engineer for the DuPage County Judicial Office Center regarding “sick building syndrome” claims.
  • Representation of the owner/developer in a dispute with a general contractor and architects over cost overruns and defects in construction of two hotels in Chicago.
  • Representation of a general contractor in several disputes with governmental entities regarding construction of water-pumping stations.
  • Representation of a steel subcontractor in a dispute with a general contractor over delays and extras in the construction of a 30-story office building in downtown Chicago.

Representative Engagements - Development and Construction Transactions

  • Represented Prime/Beitler Development Co. LLC in connection with the development of Dearborn Center, a 1.5 million square foot mixed use office/retail/parking project in downtown Chicago, including negotiation of construction contracts and architect’s agreement, anchor leases and all construction and mezzanine financing.
  • Represented U.S. Equities Development LLC in connection with its development of a new $350 million world headquarters for Compuware Inc. located in downtown Detroit, including negotiation of development agreement with Compuware, construction contracts and architect’s agreement, and related agreements with the City of Detroit.
  • Represented General Dynamics Corp. in connection with the conversion of an industrial facility into a mixed-use office, industrial, residential and golf-course development located in Rancho Cucamonga, California.
  • Represented Eli’s Cheesecake in connection with its development of a new manufacturing facility in Chicago, including negotiations with City of Chicago regarding Tax Increment Financing, negotiation of build-to-suit contract and IRB financing.
  • Represented Tenneco Inc. in connection with development of two corporate headquarters buildings in Lake Forest, Illinois for Pactiv and Tenneco Automotive, including negotiation of ground leases and build-to-suit contracts.
  • Represented Jupiter Realty Corp. in connection with development of a mixed use multi-family/retail/ commercial project located in Lakemoor, Illinois, including zoning and land use planning issues.
  • Represented Cole Taylor Bank in connection with development of several new facilities including negotiation of ground leases, zoning subdivision and other land use planning issues, construction contracts and architect’s agreement.
  • Represented Forest City-Harris Group in connection with the development of the Seven Bridges project, a 100-acre land parcel located in Woodridge, Illinois, including land use planning and construction issues involving residential and retail uses and a 14-screen movie theater.
  • Represented The Chicago Park District in connection with the development and financing of the Soldier Field renovation to be undertaken by the Chicago Bears.
  • Represented Millennium Park Inc., the not-for-profit fund-raising entity for various enhancements of the City of Chicago’s Millennium Park Project, in connection with development and financing of Millennium Park, including negotiation of design agreement with Frank Gehry & Associates and various other design and development agreements.
  • Represented the American Academy of Dermatology in connection with the acquisition, development and financing of its corporate headquarters facility in Schaumburg, Illinois, including the negotiation of acquisition and development agreements, the construction contract and architect’s agreement, industrial revenue bond financing agreements and credit enhancement documentation.
  • Represented LaSalle Bank N.A. in connection with construction and bridge loans for the redevelopment of the Medinah Temple block (including a Bloomingdales Furniture Store) in the River North area of Chicago, including pledge of Tax Increment Financing proceeds.
