Professional Responsibility

For nearly 40 years, the attorneys in our Professional Responsibility Practice has represented law firms and lawyers across the country seeking counseling or an aggressive defense in their most serious and sensitive matters.  The majority of our work is for large law firms, but we also represent regional firms, local firms and individual lawyers.  We are proud and appreciative that our peers seek us out to be “lawyers’ lawyers.”

We have extensive experience in the specific issues of importance that law firms face, no matter what the forum.  Our lawyer and law firm representations include not only defending legal malpractice and related litigation, but we also routinely engage in pre-litigation counseling and conduct internal investigations at law firms that prevent the filing of a lawsuit against the firm.  We are frequently retained to assist law firm general counsel in evaluating their most complex issues.

We have substantial experience and success in resolving matters in a wide array of substantive practice areas in which professional responsibility claims or other issues can arise.  These include:

  • Corporate advice/failed transactions

  • Complex civil litigation

  • Patent prosecution and litigation

  • Regulatory matters

  • Breaches of fiduciary duty

  • Taxation/tax shelters

  • Real estate issues

  • Trusts and estates

  • Labor law/employment discrimination

  • Conflicts of interest

  • UCC and security interests

  • Billing disputes

  • Allegations of fraud

  • Closely held corporations

  • Partnership dissolution/firm labor disputes

  • Breaches of confidentiality

  •  Criminal litigation and investigations

  • Disciplinary proceedings/sanctions litigation

Our Professional Responsibility Practice is co-chaired by two Fellows of the American College of Trial Lawyers.  We are uniquely situated to address the most pressing issues facing law firms because we have decades of experience in handling these types of matters, and understand the sensitive nature of these claims.  We handle all such matters with the utmost confidentiality.  Additionally, because claims against law firms typically implicate the “case within the case,” we rely on the subject-matter knowledge and experience of Jenner & Block attorneys from other practice areas in order to efficiently and effectively respond to claims against our law firm clients.
