We act as confidential counselors and experienced advocates to resolve the complex issues that arise when an attorney or a law firm faces a charge of malpractice, other claims relating to professional liability or ethical violations. We offer our clients extensive experience, a thorough understanding of the law and a deep awareness of the sensitive issues involved. Our primary focuses are providing the very best legal representation and safeguarding the reputation of our clients.
For nearly 40 years, our practice has represented individual clients and law firms in significant legal malpractice cases involving claims of attorney misconduct. We have represented more than 75 law firms across the country. We have represented lawyers and law firms in many types of malpractice and related claims in diverse substantive areas including real estate, environmental contamination, tax and corporate transactions, securities issues and commercial litigation. Our practice has developed experience with malpractice claims arising from patent prosecution and litigation matters, particularly claims of attorney negligence relating to clients’ international and domestic patent portfolios. Our attorneys also provide counseling to law firms regarding labor, employment and benefits matters for both attorney and staff employees.
We have experience defending lawyers in state disciplinary proceedings, civil and criminal contempt hearings, and sanctions litigation. Specifically, we have handled matters alleging conflicts of interest, aiding and abetting, fraud, over-billing, breaches of fiduciary duty, misrepresentations, and the failure to preserve documents. In addition, lawyers and law firms facing criminal allegations and government investigations turn to us for representation in pre-litigation counseling and trials involving fraud, regulatory violations and other charges.
We work to resolve matters in the best interest of our clients at all stages in a case, from pre-litigation strategies to settlement negotiations, mediations and litigation. We not only address the immediate claims at issue, but also consider any broader underlying issues that may have led to the allegations of ethical breaches. We consult with parties across the table to develop potential settlements and to mitigate harm to the underlying clients, while ensuring that our clients achieve the best resolution possible.
Over the years, our attorneys have been consistently recognized as highly skilled counselors and litigators. Four of our lawyers, Jeffrey D. Colman, William D. Heinz, Terri L. Mascherin and Michael McNamara, are Fellows of the American College of Trial Lawyers. In addition, members of the group include attorneys who act as Firm Counsel for Jenner & Block and who have been appointed as Special Assistant Attorneys General for Illinois
