Jenner & Block represents private and public employers in a wide range of labor, employment and benefits matters.

Our clients include major corporations, public entities and not-for-profit entities across a broad range of industries, including automotive, advertising, defense, distribution, education, gaming, high tech industries, manufacturing, professional services, sales, and commodity trading.  We advise clients on the most sensitive personnel matters.  We defend all varieties of labor, employment and benefits claims brought by individuals, government agencies and as class actions nationwide.  Our work includes:

  • Counseling employers on routine to complex personnel matters.
  • Conducting litigation avoidance counseling and training. 
  • Counseling employers on and conducting internal investigations of alleged harassment or other employee misconduct claims.
  • Defending claims brought in federal and state trial and appellate courts, and in administrative, arbitration and mediation proceedings, by individuals, federal agencies such as the EEOC, and as class actions.
  • Defending claims alleging discrimination, harassment, retaliation, violations of federal and state wage/hour laws, ERISA, FLSA, FMLA, WARN and OWBPA, and common law claims such as breach of contract, interference with contract or prospective economic advantage, invasion of privacy, defamation, and intentional infliction of emotional distress.
  • Advising employers on adverse employment actions, including terminations and reductions in force.
  • Drafting, counseling and litigating employment, severance, and restrictive covenant agreements.
  • Auditing and drafting employment policies and practices.
  • Representing federal contractors regarding affirmative action plans and obligations, and in OFCCP audits and proceedings.
  • Statistical analyses of personnel practices and decisions, such as compensation, promotion and termination decisions.
  • Advising employers on the labor and employment aspects of mergers and acquisitions.
  • Advising employers on union/management issues.
