Over the years, Mr. Englund has helped shape many aspects of current copyright law, including through:

  • Representation of the U.S. recording industry in the industry negotiations leading to the enactment of most copyright legislation of the last 25 years, including the Music Modernization Act (MMA) and Digital Millennium Copyright Act (DMCA);
  • Representation of major entertainment companies or their trade associations in filing amicus briefs or developing litigation strategy for precedent-setting copyright cases;
  • Filing comments, testifying or otherwise appearing in numerous rulemaking and other proceedings before the U.S. Copyright Office; and
  • Influential writing concerning the scope of copyright protection for computer programs, which ultimately led to the dominant standard for determining infringement of the copyrights in computer programs.

Mr. Englund combines his knowledge of substantive intellectual property law with extensive experience as a transactional lawyer to provide practical business advice to clients that create or use intellectual property or technology.  For example, he has:

  • Structured and negotiated international joint ventures and strategic alliances for development and operation of Internet portals, other online services and industrial manufacturing facilities, as well as various complex domestic joint ventures;
  • Represented a strategic venture capital fund in structuring over a hundred technology development arrangements with portfolio companies;
  • Represented music companies in negotiating key agreements that have paved the way for the use of sound recordings and musical compositions in new kinds of products and services;
  • Structured and negotiated settlements of intellectual property or technology-related disputes;
  • Negotiated countless other technology contracts, including software licenses, technology development agreements, patent licenses, outsourcing agreements, joint development agreements, online and other marketing agreements and clinical trial agreements, for clients in the entertainment, information technology, communications, financial services, biotechnology and other industries;
  • Structured and negotiated intellectual property aspects of various corporate transactions involving transfer and disentanglement of substantial intellectual property assets; and
  • Advised clients concerning a wide range of contractual and regulatory issues associated with new technology businesses, including development of privacy policies and website terms of use.
