Casey T. Grabenstein is a partner in the firm's Litigation Department.  He is a member of the Complex Commercial Litigation, Health Care, Product Liability, and Class Action Practices.  Mr. Grabenstein represents clients in a broad range of litigation matters and has experience in all phases of litigation.

Mr. Grabenstein represents corporations in a variety of complex commercial litigation disputes in state and federal courts and arbitration forums across the United States.  He has significant experience representing Fortune 500 and other major companies at the trial and appellate level in a wide range of cases, including breach of contract, product liability, toxic torts, trade secrets, securities fraud, and intellectual property matters.  Mr. Grabenstein has significant first- and second-chair trial experience. 

He is a member of  the Trial Bar for the Northern District of Illinois and has represented clients in numerous hearings and trials in federal and state courts and arbitration forums across the United States, including serving as lead counsel in multiple federal jury trials.  Representative examples include defending a large health insurance company in a number of disputes with providers and hospitals, including an arbitration that resulted in a defense verdict; serving as national counsel for a major car manufacturer in product liability cases throughout the country; successfully arguing dispositive motions in a billion dollar trade secret dispute; and leading deposition and other discovery efforts on behalf of a financial institution in pending securities litigation.

Mr. Grabenstein has been recognized by Illinois Super Lawyers as a “Rising Star” in the area of business litigation for the past three years.  Mr. Grabenstein also maintains an active pro bono practice.  After representing a Texas man on death row for eight years, Mr. Grabenstein was able to vacate his death-sentence in 2016.  He also obtained asylum for a woman from Tanzania after an immigration trial.  Mr. Grabenstein has significant experience in Section 1983 cases involving prisoners and arrestees. He has first-chaired five Section 1983 federal jury trials and argued in the Seventh Circuit on behalf of a Section 1983 plaintiff.  Mr. Grabenstein was recently appointed in two additional Section 1983 cases.  He also currently represents two clients in criminal proceedings.

Mr. Grabenstein has served as an adjunct professor for the Pre-Trial Legal Interviews and Investigations course taught at Northwestern Law School.  During law school, Mr. Grabenstein was a member of the University of Illinois Law Review, awarded the Rickert Award for Excellence in Academic Achievement, and received the CALI Award for Introduction to Intellectual Property.
