Benjamin T. Hand is an associate in the firm's Government Controversies practice, where he advises technology companies on emerging regulatory regimes, with a focus on artificial intelligence (AI), children’s online safety, risk management, and content moderation. When regulatory scrutiny turns adversarial, Ben helps clients respond to government investigations and litigation.
He works with clients to assess how enacted and pending legislation applies to their products and business lines, to build compliance plans for obligations that are often ambiguous on their face, and to develop a strategy for engaging with lawmakers and regulators as these frameworks take shape. Because new regulatory regimes are frequently challenged after enactment, Ben also advises clients on how the resulting litigation impacts their compliance obligations.
Ben also represents clients in investigations and enforcement actions brought by federal and state regulators, state attorneys general, and congressional oversight committees. When government scrutiny or bad publicity spawns private litigation, Ben represents clients in state and federal court. Ben has also prepared witnesses for depositions, witness interviews, congressional testimony, and transcribed interviews.
His broader technology practice includes advising clients on content moderation and the First Amendment, as well as emerging rules governing the deployment of autonomous vehicles.
Ben clerked for the United States Court of Appeals for the Ninth Circuit and the United States District Court for the Northern District of California. Those clerkships continue to inform Ben’s approach to novel questions of statutory, constitutional, and administrative law, which he often addresses well before a dispute reaches court.
