Petition for rehearing in SWIDA v. National City Environmental

In a rare development, the Illinois Supreme Court granted a petition for rehearing and indicated that it would rehear oral argument in an important eminent domain case, SWIDA v. National City Environmental. In May, Jenner & Block -- led by Chairman Jerold Solovy, Partners Barry Levenstam and Jeff Pitzer, and Associates Jessie Liu and Jeremy Taylor -- filed the petition for rehearing with the Illinois Supreme Court on behalf of its client, National City. A dissenting opinion in the Court's original 4-3 decision said SWIDA's use of "quick-take" eminent domain powers to transfer private property to Gateway International Raceway is unconstitutional and "akin to the tyranny our forefathers fled."
