In this Association Law & Policy article, Partner Carla J. Rozycki and Of Counsel Darren M. Mungerson discuss a recent decision that gives the National Federation for the Blind (“NFB”) the green light to pursue claims against Target Corp. that the retailer’s web site is inaccessible to the blind and incompatible with software used by the blind in violation of Title III of the Americans with Disabilities Act (“ADA”).  This article reviews how web-based ADA claims have been viewed historically, what the Target decision means, and how it may impact organizations with web sites.
