In this article, Partners Craig C. Martin and William L. Scogland discuss a proposed amendment to the Department of Labor’s Employee Benefits Security Administration Prohibited Transaction Exemption 2003-39, which broadens the ways in which plans may more heavily rely on the services of an independent fiduciary when a plan contemplates a transaction in connection with the settlement of litigation.
