Nearly two years after first proposed, on November 2, 2011, a final Federal Acquisition Regulation (FAR) rule outlines contractors’ roles in preventing personal conflicts of interest by employees performing duties “closely associated with inherently governmental functions.” 76 Fed. Reg. 68017. These duties include supporting or advising the government in planning, administering, awarding, or terminating contracts. The rule creates a new FAR Subpart 3.11, and contract clause 52.203-16: Preventing Personal Conflicts of Interest. Effective December 2, 2011, the rule applies to non-commercial item contracts and task and delivery orders.
