Climate Change Developments in 2009: New Federal Approaches to Greenhouse Gas Regulation

In this publication, Partner Gabrielle Sigel and Associate Jennifer L. Cassel discuss climate change developments during 2009, providing highlights of regulatory, legislative, litigation, and international developments, primarily from the perspective of the U.S. regulated (or to be regulated) community. These highlights include: (1) the status of GHG regulation at the end for the Bush Administration; (2) EPA’s new regulatory agenda resulting in final and proposed regulation of GHG emissions under the CAA; (3) Congressional attempts to create a GHG cap-and-trade program; (4) other federal agency action to address climate change; (4) state and regional programs; (6) tort liability developments; and (7) international efforts to reach agreement regarding a future GHG emissions reduction approach.
