In this article, Partner Andrew Weissman addresses the adequacy of the McNulty memorandum at protecting attorney-client privilege in corporate investigations. According to the article, while the Justice Department has maintained its position that the "McNulty memo is successfully countering abuses," former Delaware Supreme Court Chief Justice E. Norman Veasey said in a report to the Senate Judiciary Committee that he believed the memorandum "may not be fully effective in erasing practices that it was designed to address."
