On September 17, 2020, Senator Roger Wicker (R-Miss.) along with co-sponsors Senators John Thune (R-S.D.), Marsha Blackburn (R-Tenn.), and Deb Fisher (R-Neb.), released the Setting an American Framework to Ensure Data Access, Transparency, and Accountability Act or the SAFE DATA Act (Act). The SAFE DATA Act is the latest attempt to kick-start the federal privacy law debate. However, given everything else that is on the Senate’s agenda before the November election, it seems unlikely that the SAFE DATA Act will get any closer to passage than its predecessors. Which is to say, we are still unlikely to see a federal data privacy bill passed in 2020.
