In this article, Partner Stephen R. Brown and Associate Abraham M. Salander compare CLOs today to residential mortgage-backed securities (RMBS) in the lead-up to the Great Recession and contrast the types of claims related to RMBS that were litigated after the Great Recession with potential claims relating to CLOs.  “At this time of uncertainty,” they conclude, “one thing everyone involved in the CLO market can be doing is paying attention to loan performance and reading your deal documents closely.”
