The UK Supreme Court has upheld an appeal by Morrisons,[1] overturning the English Court of Appeal’s judgment that held the supermarket chain was vicariously liable for a deliberate and malicious data breach by an employee.  This case provides useful clarification of the law in relation to an employer’s liability for the acts of its employees in relation to malicious acts generally, not just in connection with data breaches.
