Client Alert: False Claims Act Enforcement and Recovery Steady in 2019

On January 9, 2020, the Department of Justice (DOJ) released its annual statistics on recoveries and enforcement activities in civil suits brought under the False Claims Act (FCA or the Act) for fiscal year 2019, spanning from October 1, 2018, through September 30, 2019.  Recoveries for 2019 were approximately $3.1 billion, a modest increase from 2018, when recoveries by the DOJ amounted to $2.9 billion.  The report shows a steady level of enforcement activity, with similar levels of FCA actions initiated by the government and private relators in 2019 as in 2018.  Enforcement and recovery under the FCA remain down from record levels earlier in the decade but historically high.  With such large sums at stake, FCA disputes continue to be an area of significant exposure for companies with government contracts.
