In the November Insurance Law Update, Partner Brian S. Scarbrough and Associate Catherine L. Doyle focus on the hotly debated question of whether an additional insured would be covered when an insurer’s agent issues an inaccurate certificate of insurance, or COI. They highlight a case in which the Supreme Court of Washington strengthened protections afforded to an additional insured when the insurance company’s agent issued an inaccurate COI. “Would-be additional insureds are advised to request COIs or other written representation from the insurer’s agent to reap the greatest potential benefit from this decision,” the authors suggest.
