In this article, Jenner & Block Associate Katharine R. Ciliberti summarized a panel discussion that took place during the ABA Lawyers’ Professional Liability Spring 2019 National Legal Malpractice Conference in Miami, Florida.  The topic of the discussion was the increasing number of claims being asserted against lawyers by non-clients, as well as steps lawyers can take to try to avoid such claims.  Ms. Ciliberti reported on the panel’s unique format (a skit enacting a thorny four-part hypothetical), the panelists’ hypotheses as to the reasons for the increase in non-client claims against lawyers, and other key takeaways from the discussion.
