In the August Insurance Law Update, Jenner & Block Partner Brian S. Scarbrough and SEO Fellow Donovan Hicks highlight a recent Delaware state court decision regarding whether documents issued as part of government investigations satisfy both the “claim” and “wrongful act” definitions in insurance policies. The court ruled in favor of the policyholder. The authors urge policyholders to stay aware of policy language and varying case law interpretations to determine what coverage is available for responding to government investigations.
