Client Alert: DOJ Releases Guidelines on Awarding Cooperation Credit in False Claims Act Matters

On May 7, 2019, the Department of Justice (DOJ) released, for the first time, formal guidelines on awarding credit in False Claims Act (FCA) matters to defendants who self-disclose misconduct, cooperate, and remediate.  These guidelines signal yet another step the Trump administration has taken to encourage corporate cooperation in white collar investigations and to assist prosecutors in evaluating those matters that warrant government involvement, given the surge of FCA claims in recent years.
