This second edition of Trade Secret Update focuses on the current status of trade secret law in the United States and abroad. Important aspects of US trade secret law are addressed in the Update, including the propriety of various damages theories, trade secret specification requirements, the preemptive effect of state and federal statutes, the DTSA’s ex parte seizure provision, and multiple process issues such as sanctions law and the protection of information in litigation.  On the practical side, the Update identifies recent substantial trade secret verdicts in the United States and sets out the trade secret-related provisions of the European Union’s Recent Directive; the United Kingdom’s new enforcement regulations; the NAFTA-replacing trade agreement between the United States, Canada, and Mexico; as well as the trade secret rules in the brand-new CPTPP.
