In this article, Jenner & Block Litigation Department Chair Craig C. Martin and Partner Amanda S. Amert explain that, until recently, a small group of specialized plaintiffs’ firms has dominated the ERISA class action space.  But a trend is emerging:  new plaintiffs’ firms are entering the space “in a significant way.”  This development, they observe, “has been picking up significant speed in the last several months.”  They then analyze what this trend means for employers that sponsor ERISA plans.  They conclude:  “For the moment, at least, it appears that employers should be prepared for the volume of ERISA class action lawsuits to continue to tick upward, placing a premium on learning and following best practice for day-to-day plan administration and management.”
