“Hotel Malware Attack Raises Unusual Insurance Questions,” Insurance Law Update

In their January Insurance Law Update, Jenner & Block Partner Jan A. Larson and Associate Jonathan A. Langlinais examine the insurance implications of a hotel malware attack.  The authors analyze St. Paul Fire & Marine Insurance Co. v. Rosen Millennium Inc.  In that case, the US District Court for the Middle District of Florida is poised to decide several questions about an insurer’s duty to defend a policyholder in the event of a data breach and the scope of coverage for data breaches under standard commercial general liability policies.  The authors give background of the case and highlight several issues that policyholders will want to watch closely.  The Update was republished in Law360.
