In this article, Jenner & Block Partners Gayle E. Littleton, Brian J. Fischer and Casey T. Grabenstein, and Associate Licyau Wong examine the Sixth Circuit’s ruling in Southern Glazer’s Distributors of Ohio LLC v. Great Lakes Brewing Company. The article explores the lawsuit Ohio Southern Glazers filed against Great Lakes for terminating its beer distribution agreement; the Sixth Circuit’s decision to vacate a preliminary injunction that enjoined Great Lakes from terminating a franchise-distribution agreement with Ohio Southern Glazers; and Ohio Southern Glazer’s renewed motion for injunctive relief. The authors also provide three preliminary takeaways, based on the appellate and district court decisions to date, for Ohio beverage-alcohol manufacturers who “want to have a say over whether a distributor can transfer all or part of its business.
