In this article, Jenner & Block Partners Debbie L. Berman and Justin A. Maleson examine bringing claims under the Illinois Trade Secrets Act (ITSA).  The authors explain that the ITSA preempts all noncontract state common law and statutory claims that are based on the misuse of trade secrets, but does not preempt either contractual remedies or “other civil remedies that are not based upon misappropriation of a trade secret.”  They then discuss potential claims under Illinois and federal law.
