In this article, Jenner & Block Associate Katharine R. Ciliberti covers topics raised during the Spring 2017 National Legal Malpractice Conference in Boston.  The conference was presented in April by the ABA Standing Committee on Lawyers’ Professional Liability.  Ms. Ciliberti explains that the discussion focused on lawyer impairment, its consequences and ways to identify and respond to it.  She concludes that the conference panelists noted that questions and issues surrounding impairment are difficult.  “However,” she observes, “the panelists warned the audience not to let that difficulty and uncertainty lead them to do nothing in regard to attorney impairment.  The decision not to act is a decision, and it too has consequences.”
