In this article, Jenner & Block Partners David P. Saunders and William C. Pericak explore the effect that increased attention on Health Insurance Portability and Accountability Act (HIPAA) compliance has had on the health care industry. The article also discusses potential future HIPAA policy developments under the current administration.
“With the increased scrutiny on both the documentation and implementation of HIPAA policies and agreements, HIPAA-regulated entities are stepping up their game to avoid OCR scrutiny,” the authors write. “The industry has seen, among other things, an increase in the use of third-party compliance companies to conduct HIPAA risk assessments, and an industry shift to more comprehensive — or some might say burdensome — business associate agreements.”
