In this article, Jenner & Block Partner Robert L. Byman examines the recent amendments to the Federal Rules of Civil Procedure regarding proportionality.  No less an authority than Chief Justice John Roberts tells us that the amendments “may not look like a big deal at first glance, but they are,” Mr. Byman says.  He explains that the concept of proportionality has simply been moved from one part of the rule to another, and it “does not create a new standard; rather, it serves to exhort judges to exercise their pre-existing control over discovery more exactingly.”
