In this article, Jenner & Block Partner Carrie F. Apfel examines the government’s continued use of the False Claims Act (FCA) in the fight to protect funds from fraudulent and false claims. In 2014 alone, she notes, the government recovered a record-breaking $5.7 billion in settlements and judgments in FCA cases. “The first half of 2015 has followed suit,” she observes. “In just the first six months of the calendar year, FCA actions have generated more than $1.96 billion for the government and relators.” Ms. Apfel then explores recent court rulings that could have implications for FCA actions.
