The article explains that the Court recently did away with the interpretive rules arising from the Sixth Circuit’s earlier decision in Yard-Man. In the recent case, the Court reiterated that “ordinary principles of contract law” apply to the interpretation of collective bargaining agreements and ERISA plan provisions. “In so doing, it resolved in lingering circuit split that has been giving employers headaches for more than 30 years, during which the Court repeatedly rejected numerous cert petitions seeking review of the decisions,” the authors observe.
