In this article, Jenner & Block Partner Debbie L. Berman examines best practices to help companies avoid public and courtroom battles when high-level executives depart.  She explains that departures do not have to involve public battles or litigation if handled correctly.  She offers three tips for companies: 1. negotiate severance terms when negotiating the original employment agreement; 2. document, document, document; and 3. avoid making negative statements about the departing executive.
