In this article, Jenner & Block Partner Christopher C. Chiou, Associate L. David Russell and Law Clerk Zain A. Shirazi examine the increasingly common practice of posting fake online business reviews – both positive and negative – on websites such as Yelp, Google and Amazon.  Focusing on fake negative reviews, the authors discuss the changing environment to curb the practice in various states as well as possible remedies for affected businesses, including reporting procedures for questionable reviews and litigation strategies such as defamation lawsuits.  To avoid being victimized by these reviews, the authors suggest, businesses should monitor their web footprints and where possible, attempt to informally resolve any negative comments before bringing a lawsuit.
