Partner Jerold Oshinsky and Associate Christopher S. Lindsay wrote an article in the January/February 2013 edition of the Journal of Taxation and Regulation of Financial Institutions. Titled “Practitioner’s Guide to Litigating Insurance Bad Faith Claims,” the article examines the general law surround bad faith claims, among the most litigated issues involving insurance companies. The authors set forth the legal standards at issue, the measures of proof, and specific behaviors by insurance companies that can open them up to possible liability. They then offer strategies for policyholders who litigate bad-faith claims.
