Jenner & Block Associate Damien C. Specht wrote an article titled “State Bid Protests: New Incentives and Traps for the Unwary” in the October 15 edition of the Westlaw Journal (Government Contract). The article examines the often missed opportunities for contractors to protest awards ofgovernment contracts at the state level.  Mr. Specht examines  protests of government contract awards at the state level, noting that they are less common than federal protests because they have been seen as a “fool’s errand.” But, Mr. Specht suggests, that climate is changing: Competition for state contracts has increased and the tighter fiscal landscape at the state level has brought more public scrutiny of contracting practices. In pursuing state bid protests, he discusses differences in state procedures and urges contractors to be aware of their rights.
