Victory in U.S. Court of Appeals for Exelon

Jenner & Block recently helped to secure an important victory in the U.S. Court of Appeals for the 10th Circuit for the Firm’s long-time client Exelon, reversing two jury awards in a sizable environmental mass tort case.  Working with the Denver-based firm of Moye, Giles, O'Keefe, Vermeire & Gorrell, Appellate and Supreme Court Practice Co-Chair Barry Levenstam obtained a reversal of two jury verdicts totaling over $43 million.  The court of appeals reversed the district court’s decision based on a failure to exercise the gatekeeper function under the U.S. Supreme Court's Daubert opinion.  Oral arguments in the case were presented by William A. Von Hoene, Jr., Exelon’s Vice President and Deputy General Counsel.  Mr. Von Hoene is a former Partner of Jenner & Block.
