On April 7, 2005, the United States District Court for the Western District of Pennsylvania granted summary judgment in favor of Jenner & Block client SPX Corporation and Resolite (a former SPX business unit) in an age discrimination and harassment lawsuit.  SPX and Resolite were represented by Partner Daniel J. Winters and Associate Darren Mungerson.

In the lawsuit, the plaintiff alleged that he was improperly terminated as part of a reduction in force.  He further alleged that he was treated unfairly on account of his age.

SPX and Resolite denied plaintiff's allegations, and argued to the Court that plaintiff's complaint failed to state a legally viable claim.  Senior United States District Court Judge Maurice B. Cohill, Jr. agreed, and held that SPX did not improperly terminate plaintiff due to his age.  Similarly, the Court rejected plaintiff's harassment claim because there was no evidence that SPX's or Resolite's actions were motivated by any age animus.  As a result of the Court's ruling, the case was dismissed with prejudice in its entirety.
