A written policy that identifies “questionable practices” and encourages employees to report such conduct is a key component of a strong corporate compliance program, according to Jenner & Block Partner Carla J. Rozycki in a September Counsel to Counsel “brief advice” article.
The policy should be circulated to employees on a regular basis and be “followed and endorsed from the top down,” added Ms. Rozycki, Co-Chair of the Firm’s Labor & Employment Practice.
In addition, employers should ensure that any investigation into questionable practices remains confidential, take appropriate corrective action and prohibit retaliation by employees.
