In the latest edition of Gartner Business Quarterly, Partner Rachel K. Alpert discusses the complications businesses are facing when seeking to comply with the economic sanctions aimed at Russia and Belarus following the invasion of Ukraine. She explains best practices for overcoming the complexities global sanctions present, including the use of screening tools and adding contractual provisions to address the sanctions.
“Take stock of your existing contracts and identify any potential force majeure clauses or other avenues that allow for extricating yourself in the event of sanctions,” said Ms. Alpert. “Going forward, include those clauses in new contracts. Although be mindful of local requirements that might make negotiation of or reliance on such clauses illegal.”
