On April 15, the US Court of Appeals for the Sixth Circuit heard arguments in City of Eugene, OR, et al. v. FCC, et al. Petitioners challenged the FCC’s landmark 2019 order clarifying the scope of state and local regulation of cable systems and the limits on cable franchise fees under the federal Cable Act. Jenner & Block represents NCTA, the national cable trade association, as intervenor in support of the FCC’s order. The outcome of this case will shape the future of cable regulation.
