Firm Team Secures Bid Protest Win for Business Integra Technology Solutions

A firm team led by Special Counsels Noah B. Bleicher and Carla J. Weiss secured a significant bid protest win for client Business Integra Technology Solutions. Since 2014, Business Integra has provided information technology support services for the Department of State’s Bureau of Diplomatic Security. After learning that the State Department selected another vendor for the follow-on $100 million contract, Business Integra engaged the firm to challenge the selection decision at the US Government Accountability Office (GAO).

Jenner & Block’s experienced team of government contracts practitioners filed an initial bid protest at the GAO late last year. The protest raised numerous concerns regarding the State Department’s evaluation of quotations and award decision. After multiple rounds of voluntary corrective action, the GAO resolved the merits of the protest in its decision in favor of Business Integra on July 7. In sustaining the bid protest, the GAO agreed with the team’s assertions that the State Department misevaluated the presumptive awardee’s past performance, unreasonably assigned quotation weaknesses, and reached a flawed best-value tradeoff determination.
