Firm Team Files Lawsuit Against Trump Administration Over its Public Charge Rule

Jenner & Block Partner Matthew E. Price and Associate Elizabeth B. Deutsch are serving as co-counsel to multiple individuals and non-profit organizations suing the Trump Administration over its implementation of the "public charge rule,” which bars low-income immigrantsfrom obtaining permanent residence.  The lawsuit claims that U.S. Citizenship and Immigration Services’ new Policy Manual contradicts and reaches beyond the public charge rule and the Immigration and Nationality Act.  According to the lawsuit, the Policy Manual creates an arbitrary and illegal Catch-22: Noncitizens applying for green cards have the very fact that they are seeking green cards counted against their applications.  The Policy Manual also, without acknowledgment or explanation, unlawfully raises the standard of proof for applicants to establish their admissibility to the United States.  The lawsuit challenges the Policy Manual’s illegal departure from federal law to discourage, reject, and deny meritorious applications for green cards.
