NCAI and AAIA File Amicus Brief in Bears Ears Litigation

On behalf of the National Congress of American Indians (NCAI) and the Association on American Indian Affairs (AAIA), Jenner & Block filed an amicus brief in the US District Court for the District of Columbia in the legal challenge to the Trump Administration’s attempt to diminish the Bears Ears National Monument in southern Utah.  “NCAI’s brief brings together knowledge and perspectives from a wide variety of tribes—to help the Court understand how important Bears Ears is to thousands of Indian citizens,” said NCAI General Counsel Derrick Beetso.  AAIA Executive Director Shannon Keller O’Loughlin added:  “Without the designation of Bears Ears as a National Monument where Tribal management is a cornerstone to the Monument’s protection, our sacred Bears Ears will be lost to development—and so will our faith in the government-to-government relationship between Tribal nations and the US government.”

Partner Sam Hirsch, co-leader of the firm’s Indian-law work, and Partner Thomas J. Perrelli represent NCAI and AAIA in this matter, assisted by Associate Leonard R. Powell, a member and former elected leader of the Hopland Band of Pomo Indians.
