On November 13, a Jenner & Block team achieved a significant victory in Delaware Chancery Court on behalf of our client, Equus Total Return.   Equus, which is a closed-end mutual fund, was sued by a putative class of shareholders who sought to enjoin Equus from completing an Equity Incentive Plan because of allegedly insufficient disclosures in its proxy materials.  Rejecting the plaintiffs' arguments, the court granted summary judgment in favor of Equus and its directors and dismissed the case with prejudice.  The successful Jenner & Block team members were Partners Martin C.
