Jenner & Block recently won a victory for Marriott in a long-standing patent infringement case regarding menu generation and synchronization systems on handheld devices. In Ameranth, Inc. v. Marriott, Intl. et al.,Ameranth asserted that Marriott, along with dozens of other restaurant, hotel and online ordering companies, had infringed four of its patents. Marriott and its co-defendants successfully invalidated three of the Ameranth patents in the USPTO. In September, a week before a series of trials were set to begin, Judge Dana Sabraw of the Southern District of California ruled that all asserted claims of Ameranth’s last remaining patent were invalid for claiming an abstract idea under the US Supreme Court’s landmark Alice decision. Ameranth has appealed the court’s final judgment to the Federal Circuit Court of Appeals. Partner Nick G. Saros and Associate David A. Gomez represent Marriott in the matter.
