In an article (subscription required) titled “Eight Major SCOTUS Cases to Watch,” The National Law Journal previews Marinello v. United States, a high-profile tax case set to be argued this fall. Jenner & Block Partners Matthew S. Hellman, Geoffrey M. Davis and David Bitkower lead the team representing the petitioner, Carlo Marinello, on a pro bono basis.

The article explains that the main question in the case is “does a taxpayer need to know that he or she is being investigated by the IRS to be charged with obstruction of justice?” The article also predicts that Marinello could be the latest in a series of decisions “in which the justices narrowed the reach of criminal omnibus obstruction of justice laws” and states that “the high court has voiced concerns about prosecutorial abuse of those omnibus clauses as well as about overcriminalization.”
